President’s Rule in Manipur

 

Context:

Recently, President’s Rule was imposed in Manipur after  the resignation of Chief Minister N. Biren Singh.

Why was President’s Rule imposed?

  • Ethnic violence since May 3, 2023 between the Meitei and Kuki-Zo communities, resulted in over 250 deaths and the displacement of around 60,000 people.
  • Understanding the lack of political stability in the state and increased concerns about long-term governance and security, the President Droupadi Murmu issued a proclamation under Article 356 after receiving a report from Governor Ajay Kumar Bhalla.

 

What is President’s Rule?

  • President’s Rule is a situation when the state government is suspended and taken over by the Central Government.
  • During a President’s Rule, the concerned state comes under the direct administration of the Centre.
  • It is imposed under Article 356 of the Indian Constitution when the state government is unable to function according to constitutional provisions.

 

When is it imposed?

  • Failure of Constitutional Machinery: If the Governor of the state feels that the situation has arisen that the state government cannot function as per the Constitution, he reports to the President to proclaim the President’s Rule.
  • No Clear Majority in Assembly: If no political party or coalition can form a stable government after elections.
  • Breakdown of Law & Order: If there is widespread violence, insurgency, or internal disturbance making governance impossible.
  • Failure to Comply with Union Government Directions: If the state does not follow constitutional directives issued by the Central Government.

 

How Long Can It Last?

  • Initially imposed for six months.
  • Can be extended up to three years with parliamentary approval every six months.
  • Requires approval from both Lok Sabha and Rajya Sabha within two months of imposition.

 

Effects of President’s Rule

  • State Government Dismissed: The Chief Minister, Council of Ministers, and Legislative Assembly are either dissolved or kept under suspended animation.
  • Governor Takes Control: The Governor administers the state on behalf of the President, with the help of bureaucrats.
  • Parliament Controls Law-making: The Parliament takes over the legislative powers of the State Assembly.

 

Revocation of President’s Rule

  • Can be revoked anytime by the President before six months if normalcy is restored.
  • Automatically ends if a new government is formed in the state.

 

Concerns & Criticism

  • Misuse for political reasons: Historically, it has been used to dismiss opposition-ruled governments.
  • Threat to federalism: weakens the autonomy of states.
  • Judicial Safeguards: The Supreme Court (SR Bommai case, 1994) ruled that judicial review is allowed to check misuse.

 

Conclusion:

President’s Rule is meant to be a temporary emergency measure to restore stability and governance in a state.
