A Court Order that was Barking up the Wrong Tree


Why in News?

  • On 11 Aug 2025, the Supreme Court ordered that all street dogs in Delhi be rounded up and kept in shelters.

  • Order criticised as unscientific, legally flawed, and morally questionable β†’ stayed on 22 Aug 2025.

  • Final hearing is still pending.


Problems with the SC Order

1. Public Health Risks

  • Shelters = high stress, overcrowding β†’ aggression, fights, injuries.

  • Spread of zoonotic diseases (rabies, leptospirosis).

  • Historical failures: US β€œpound system” β†’ capture & kill cycle.

2. Ecological Concerns

  • Vacuum effect: removing local dogs β†’ migration from neighbouring States (Haryana, UP).

  • Dogs act as scavengers β†’ their removal may trigger rise in rodents & monkeys.

  • Order contradicts WHO & NAPRE (National Action Plan for Dog Mediated Rabies Elimination) β†’ both recommend sterilisation + vaccination.

3. Legal & Constitutional Issues

  • Contradicts SC’s 2024 Maheshwari Bench order upholding Animal Birth Control (ABC) Rules, 2023.

  • Violates Article 51A(g): duty to show compassion to living creatures.

  • Inconsistent jurisprudence β†’ undermines legal certainty.

4. Social Misrepresentation

  • Framed as β€œdog-loving elite vs poor bite victims.”

  • In reality: street dogs play a symbiotic role in urban ecosystem.

  • For Delhi’s homeless, dogs provide companionship & protection.

5. Political Distraction

  • Diverts attention from real governance failures:

    • voter fraud allegations, corruption, inflation, crumbling infrastructure, flooding roads.

  • MCD failed to implement ABC programme effectively.


Proven Humane Solution: Animal Birth Control (ABC) Programme

  • Sterilisation + vaccination = only scientific, humane method.

  • Success in Jaipur, Jodhpur (stable population decline + rabies control).

  • Failures in Delhi due to: poor budgets, unmet targets, lack of accountability (MCD, AWBI).


Way Forward

  • Implement ABC Rules, 2023 uniformly across India.

  • Evidence-based targeted capture: only aggressive dogs β†’ observed humanely.

  • Strengthen MCD’s accountability for rabies control & sterilisation.

  • Public awareness campaigns on coexistence & responsible waste management.
